Mother, who returned to the car to find her 1-year-old son unresponsive with a seat strap wrapped around his neck after leaving him alone for about half an hour, faces more charges
Texas – In a devastating case that continues to unfold out of Texas, a 26-year-old mother, identified as A. Rivera, is now facing multiple criminal charges after her 1-year-old son died from strangulation caused by a car seat strap. The case, which initially resulted in one felony charge, has now expanded to include criminally negligent homicide and abandoning a child with imminent danger of bodily injury, according to updated jail records.
Rivera, the boy’s mother, was rebooked into the county jail last Wednesday following the additional charges. As of Monday afternoon, she remained behind bars, now held on a $60,000 bond. Authorities have not disclosed if bond has been posted. Rivera had originally been charged with injury to a child causing death, a second-degree felony under Texas law. But after further investigation and forensic findings, prosecutors moved to file additional charges reflecting the gravity of the circumstances surrounding the child’s death.
The fatal incident occurred on the evening of October 31, 2023. According to a statement released by the sheriff’s office, deputies were dispatched shortly before 9:00 p.m. in response to a call reporting an unresponsive infant inside a parked vehicle. Upon arrival, deputies discovered the 1-year-old child in the back seat of a car, unconscious and still strapped into his car seat. The seat had tipped forward, and a strap had wrapped tightly around the child’s neck. Paramedics rushed the infant to a local hospital, but he was pronounced dead shortly after arrival.
Authorities said Rivera told investigators that she had arrived at the location with her four children, and left the 1-year-old in the vehicle because he was sleeping. She took the other children inside, reportedly intending to return shortly. Between 20 to 30 minutes later, a witness went to the vehicle and discovered the child unresponsive. By then, it was too late. An autopsy conducted days later officially determined the cause of death was strangulation, confirming that the car seat strap had fatally compressed the child’s neck.
While the physical cause of death has been confirmed, many details remain unclear. Law enforcement has not disclosed what Rivera and her other children were doing inside the residence or why the 1-year-old was left unattended for so long. The exact relationship between Rivera and the person who called for help has also not been revealed. According to reports, the additional charges suggest that prosecutors believe Rivera’s actions created not just neglect, but an imminent and preventable danger to her child. The case remains under active investigation, and authorities have asked that anyone with additional information come forward. As of now, Rivera has not entered a plea on any of the charges.
